Litigation

Our team have successfully garnered a combined experience spanning several decades in litigating civil, commercial and criminal cases before superior courts of records including High courts, Court of Appeal and the Supreme Court. We have also defended our clients before administrative and ad hoc Tribunals including Election Petition, Tax Appeal and Securities Tribunals, Court Marshal and other inferior courts across Nigeria on diverse subjects within our core area of practice. Our vast knowledge of the extant legal environment in Nigeria and experience in representing both individual and corporate clients have effectively positioned us to deal with complex legal issues that arises multi -party and multi jurisdictional causes.


Alternative Dispute Resolution
Arbitration, Mediation & Conciliation

Our approach to dispute resolution is to embark on litigation as an option of last resort. We encourage parties to settle their disputes amicably out of court. The challenges of litigating commercial disputes, particularly those arising from international contracts are enormous and may be counterproductive in the long run; even for the winning party usually because of the uncertainty and unpredictability; as to the ultimate outcome and time frame associated with litigation. Arbitration therefore has become the preferred mode of dispute resolution in commercial disputes. Arbitration is essentially a private process for the binding resolution of a dispute through decision of one or more private individuals selected by parties to the dispute. The Arbitral process may take place within the framework of an ad-hoc arrangement, where the parties devise their own procedure or within the context of established Arbitration institutions. At Phoenix & Volge we have developed the capacity and expertise in that regard and we are poised to deliver on our promise. Other forms of non-binding means of dispute resolution includes: conciliation, mediation and negotiation; which may be expedient in certain situations. Dr. Emmanuel Sani holds a doctorate degree in International Economic law, a Master of Law Degree in corporate and commercial law and a Postgraduate Diploma in Business Administration and Management. His practice areas include transactional dispute resolution and litigation; covering practice areas such as admiralty, secured credit, intellectual property, tax, company, labour, contract, real estate, product liability, administrative, constitutional, corporate finance, securities, investment, and regulatory compliance. He has built this expertise for over 15 years in active legal practice. Mr. Patrick C. Aloamaka is a Senior Associate in the Firm’s Corporate-Commercial Department.

He has accumulated years of experience counseling Nigerian and foreign clients on several aspects of Corporate and Energy Law and his areas of specialization include Data Protection, Private Equity, Energy (Oil and Gas, Power and Infrastructure) and Company Secretarial Practice.

He obtained his LL.B (HONS) degree in 2011 from Ambrose Alli University, Ekpoma and proceeded to the Nigerian Law School where he was awarded the Barrister at Law certificate in 2012. After his National Service in 2013, he then proceeded to the University of Benin, Benin where he obtained his LL.M degree in 2016. He is currently undertaking his Doctorate degree in Law at the University of Benin.

He is also a lecturer in the Faculty of Law, University of Calabar, Calabar, Nigeria and an exemplary researcher with several academic papers published both locally and internationally to his credit.
